If your circumstances have changed since you divorce, you have the right to ask the court to modify your current child support, child custody and child visitation orders. If you are the custodial parent and your the non-custodial parent has failed to pay the court ordered child support amount or has paid less than the court has ordered, you may ask the court to use other means to enforce the standing court orders, including garnishment.

In Florida, a motion for contempt for failure to pay support may come from different methods. If support payments are made from one parent to the other, the custodial parent may file a private action to enforce a child support order. If child support payments are made through the court, the Florida Department of Revenue may file a motion for contempt. in the event you have moved to Florida after a divorce has been finalized which has a standing child support order from another state, you can have that child support order registered in Florida so that you may have the child support order enforced in the Florida courts.

The failure to pay support in Florida may have serious consequences. If the motion for contempt is granted, the Department of Revenue can suspend your driver's license, levy your bank accounts, seize your tax returns or report you to a credit bureau.
